A lot of NRIs assume that buying property in Delhi means picking a ready-made flat from a brochure. But many NRI families actually prefer a different route: buying a plot of land and having an independent floor built exactly the way they want it — rather than settling for a standard apartment layout. Here's what that process looks like, and what to keep in mind if you're managing it from abroad.

1. Why NRIs Often Choose Land + a Built Floor Over an Apartment

An independent builder floor gives you a separate entrance, no shared society maintenance charges, and full control over layout, floor plan, and finishing — things a pre-built apartment doesn't offer. Land in a good Delhi locality also tends to appreciate well on its own, and constructing to your own specification means the end result matches what your family actually needs, whether that's for personal use, renting out, or eventual resale.

2. Can NRIs Legally Buy Land in Delhi?

Under FEMA rules, NRIs and OCI cardholders are permitted to purchase residential and commercial property in India, which includes land meant for construction. The one major exception is agricultural land, plantation property, or farmhouses — NRIs generally cannot purchase these without special RBI approval. For a residential plot meant for building a floor, the standard purchase process applies.

Since most NRIs can't be in Delhi for every site visit, registration appointment, or construction milestone, a notarized and apostilled (or embassy-attested) Power of Attorney is usually the practical solution. It allows a trusted representative — a family member or your project consultant — to sign documents, coordinate approvals, and supervise construction on your behalf, while you stay informed remotely.

Note: POA documents executed abroad typically need to be attested at the Indian embassy/consulate and adjudicated with the local sub-registrar in Delhi before they're valid for property transactions. Requirements can change, so confirm the current process before finalizing your POA.

Property payments from NRIs are usually routed through NRE, NRO, or FCNR bank accounts, with all funds transferred through regular banking channels — cash transactions are not permitted. If you plan to sell the property later and repatriate the proceeds abroad, there are RBI limits and documentation (like Form 15CA/15CB) involved, so it helps to plan this at the time of purchase rather than after.
